# China tightens laws: when 12-year-olds can go to prison

New rules have come into force in China, radically changing the approach to criminal liability for minors. The Supreme People's Procuratorate and the Ministry of Public Security of the country have issued a decree allowing children aged 12 to 14 to be prosecuted for committing particularly serious violent crimes. The document, consisting of 15 articles, came into effect on July 31.

### New criteria for liability

The new norms regulate the application of the provisions of the amended Criminal Code, which was updated back in March 2021. According to the text of the decree, teenagers under the age of 14 can be held liable only for intentional homicide or intentional infliction of bodily harm resulting in death or disability.

The key condition for initiating a case is the use of particularly cruel methods. In addition, the crime must be accompanied by serious circumstances, and the prosecutor's office must give official permission to initiate a criminal case.

### Procedure and age verification

The document details the criteria determining "serious circumstances" and establishes procedural frameworks for interaction between the police and the prosecutor's office. Special attention is paid to the procedure for verifying the age of the suspect. Prosecutors are obliged to conduct a thorough investigation, taking into account a number of factors:

- Family circumstances and the presence of guardianship;

- Personal qualities and motives for the crime;

- Social connections and level of education;

- The teenager's behavior after committing the crime;

- The opinion of the victim's family.

If the police decide to initiate a case, the materials are sent to the prosecutor's office of the same level, and then transferred to the Supreme People's Procuratorate for final consideration. This multi-stage system is designed to minimize the risks of judicial errors.

### Balance of interests

The new rules are aimed not only at fighting crime but also at protecting the rights of all participants in the process. The document emphasizes the need to comply with the legitimate interests of minor suspects, as well as the protection of the rights of victims and the maintenance of public order.

In recent years, China has consistently lowered the age of criminal responsibility, while simultaneously strengthening educational and rehabilitative measures. The goal of these changes is to prevent teenagers from committing serious crimes and to ensure justice in cases where the lives and health of citizens are at stake.
