# The Danger of Premature Return: Council of Europe Commissioner Warns of Risks in Rolling Back Protection for Ukrainian Refugees

European states are strongly advised against prematurely dismantling temporary protection mechanisms and social support measures for millions of Ukrainian refugees. This warning was issued by Michael O’Flaherty, the Council of Europe’s Commissioner for Human Rights. His statement comes amid active debates across Europe regarding the reduction of aid and the restriction of access to protection status for certain categories of citizens, particularly men of conscription age.

### Risk of Poverty and Legal Uncertainty

The Commissioner expressed serious concern over current trends. In his view, withdrawing people from collective protection without establishing a reliable social foundation will lead to catastrophic consequences. Millions of Ukrainians risk falling into a state of legal uncertainty and poverty. Furthermore, such actions could force individuals to return to dangerous conditions against their will, which contradicts the principles of human rights protection.

### Escalation of Threats in 2025–2026

Michael O’Flaherty emphasized that the situation in Ukraine remains critical. The number of civilian casualties in 2025–2026 has reached the highest level in the entire history of the conflict. Missile and drone attacks by the Russian Federation continue to strike targets across the country, including western regions that were previously considered relatively safe. This makes the return of refugees to their homeland an extremely risky step.

### History and Prospects of Temporary Protection Status

The collective protection mechanism was introduced by the European Union in March 2022. Initially, the status was granted for one year, but due to ongoing hostilities, it has been extended multiple times. Most recently, the validity period of protection was officially extended until March 2027.

The European Commission is already preparing a new official proposal to regulate the status of Ukrainian refugees, which will be effective from March 2027. Based on this document, the EU Council will make a final decision on further steps. Brussels assures that support for Ukraine remains unwavering, and any future legislative changes will be directed solely toward assisting the country and its citizens.
