# Deferral, forgery, and court: how the TCC explained the mobilization of a father with a daughter

New details have emerged in the case regarding the mobilization of a father raising a 5-year-old daughter. The Pokrovsko-Ternovsky District TCC commented on the refusal of deferral and stated there are signs of document forgery. This was reported by RBC-Ukraine, citing the testimony of TCC head Nikolai Korolenko in the Verkhovna Rada.

### The law requires a court decision

According to Korolenko, on June 19, the man submitted an application for deferral through the CNAP, citing the independent raising and maintenance of a child. However, as the TCC head explained, the law provides for such a deferral only upon the existence of a court decision confirming specifically the fact of independent raising and maintenance.

The Saksagansky District Court did indeed issue a decision on the dissolution of the marriage and determining the child's place of residence with the father, but it did not provide a conclusion regarding the independent raising and maintenance of the daughter. It was precisely this circumstance that became the basis for the refusal of deferral.

Korolenko emphasized that the decision was not made by him personally, but by a special commission at the military administration of Kryvyi Rih. He also reminded that according to the Family Code, the dissolution of a marriage in itself does not mean that one parent raises the child independently — both parents retain equal rights and obligations.

### Signs of forgery in documents

During his speech, the TCC head stated that during the document check, signs of forgery were discovered. The copy of the court decision submitted by the conscript differed from the document published in the official registry of court decisions.

"When checking the documents provided by the relevant person, this decision was falsified, as evidenced by the discrepancies between what the conscript provided and what is available on the court proceedings website," Korolenko stated.

### Public outcry and Ombudsman's investigation

The story of the mobilization of a father who was raising a 5-year-old daughter himself caused a wide public outcry. Ombudsman Dmytro Lyubynets reported that the man was mobilized while the child was in kindergarten. Following this, the Ombudsman began an investigation into the legality of the mobilization and the observance of the child's rights.

The situation remains under the close attention of the public and human rights defenders. It is expected that the results of the Ombudsman's investigation will clarify all the circumstances of the case.
