# Disability Pension in Ukraine: Why It Is Not Assigned Automatically and What Work Experience Is Required

In Ukraine, the right to receive a disability pension for citizens of working age does not arise automatically. This was stated by Elizaveta Korobeinikova, a lawyer from the 'Actum' lawyers' association, in a comment to RBC-Ukraine. The expert emphasized that the key factor for assigning payments is the presence of insurance work experience, regulated by the Law 'On Mandatory State Pension Insurance'.

### Work Experience Requirements: From 1 to 14 Years

The number of years required to obtain the status of a disability pensioner depends directly on the age at which disability occurred and the established disability group. The lawyer explained that the legislation sets different thresholds for various categories of citizens.

For persons with a disability of Group I, the requirements vary as follows:

    - If disability occurred before the age of 25, the minimum insurance work experience is only 1 year.

    - The maximum required work experience for this category is 10 years. This requirement applies if disability occurred between the ages of 54 and 59.

For citizens with a disability of Group II and III, the rules are stricter:

    - A minimum work experience of 1 year is required if disability is established before the age of 23.

    - In the event of disability occurring between the ages of 56 and 59, one must have 14 years of insurance work experience.

### Exceptions and Social Assistance

There are exceptions to the general rule where a pension is assigned regardless of the presence of insurance work experience. However, if a person does not have the required number of years worked, they do not receive a pension but are entitled only to state social assistance. According to the lawyer, the amount of such payments is usually significantly lower than a disability pension.

### How to File Documents: Submission Nuances

To assign a pension after disability is established, one must independently submit an application to the pension authority. Lawyer Elizaveta Korobeinikova warned about the importance of complying with formalities when submitting documents to avoid rejection:

    - When sending an application to the Pension Fund of Ukraine (PFU) by mail, notarized copies of all documents must be attached.

    - When submitting documents through the electronic portal, scan copies or photo copies made exclusively from original documents are sufficient.

The amount of the pension also depends on the established disability group, which the legislature provided for when calculating payments.
