On September 8, the International Register of Damage Caused by the Aggression of the Russian Federation against Ukraine (RD4U) opened the possibility of submitting claims in additional categories for Ukrainian citizens. This was announced by Yelena Shulyak, chair of the Verkhovna Rada committee on state governance, local self-government, regional development and urban planning, according to RBC-Ukraine. According to her, after the launch of these directions, all claim categories for individuals in the Register became open for submission.

### What exactly can now be claimed

Among the new directions is category A4.1, which concerns persons who have not received necessary medical care for a prolonged period. The basis for the claim is the destruction or damage to medical infrastructure, as well as the inability to reach a medical facility. Separately, the right to submit claims is recorded for persons receiving education: children — through their legal representatives, adults — independently, if for a significant period they had no opportunity to study due to the destruction or damage of schools, colleges and universities, the physical danger of education, as well as official prohibitions or discrimination related to occupation or hostilities.

### Moral harm and “residual” damages

Category A2.10 is intended for recording moral harm, mental anguish and suffering caused by violations of international human rights law, international humanitarian law, or the laws and customs of war. It covers cases that do not fall under other special categories — in particular, violence experienced and other unlawful actions by Russian military and occupation forces. Category A3.7, in turn, allows claiming property and economic damages that do not fall under other categories of the Register. According to Shulyak, at the current moment the Register has opened 37 of the 43 planned claim categories for individuals and legal entities, as well as state and local government bodies.

There is a discrepancy between sources in the number of simultaneously open directions. The original publication (citing RBC-Ukraine and Yelena Shulyak) mentions four new categories — A4.1, the education direction, A2.10 and A3.7. At the same time, the publication Korrespondent, in a separate note, reports that the International Register of Damage added two new claim categories. Previously, the Register had already opened category A3.4 “Loss of paid work” — through “Diia”, claims could be submitted by employees and self-employed persons who lost their job or income due to Russian aggression, and before that, the possibility to claim under category A1.2 regarding forced displacement beyond Ukraine appeared. Shulyak emphasized that each such claim helps not only the affected person to record the damage caused by Russian aggression, but also all of Ukraine — to build an evidentiary base for a future compensation mechanism.
