# Selling a car in Ukraine: why the contract price cannot be lower than market value and how to avoid problems

The car market in Ukraine operates under strict state control aimed at combating tax evasion. The main MVS service center has issued an important clarifying signal to everyone planning to sell or buy a vehicle: before the transaction, the market value of the car must be officially determined. Ignoring this step can lead to legal complications and refusal of registration.

### Tax Code against price understatement

The requirement for valuation is dictated by the norms of the Tax Code of Ukraine. According to current legislation, the amount written in the sales contract must not be lower than the officially established market value of the vehicle. This rule is designed to eliminate the practice of "gray" deals, where the price is understated to reduce the tax base.

To legalize the transaction, an expert opinion is required. It can be obtained at the institutions of the MVS Expert Service. Specialists of the department conduct an analysis, taking into account a number of factors affecting the real price of the car, and issue an official document. It is this document that becomes the basis for the correct completion of the contract.

### Who is required to undergo valuation?

It is important to understand that the requirement to provide a document on the estimated or average market value does not apply to all sellers. It applies to the sale of the second and each subsequent vehicle. This rule covers a wide range of equipment: from passenger and cargo vehicles to buses and trailers.

Without this document, notarization of the transaction and subsequent re-registration of the car to the new owner are impossible. Service center administrators are guided by the Cabinet of Ministers Resolution No. 1388, which regulates the re-registration process.

### Geography and re-registration procedure

The MVS has simplified logistics for citizens: vehicle re-registration can be done at any territorial service center, regardless of the owner's place of residence or registration. This eliminates the need to travel to one's home region to complete the paperwork.

The department strongly recommends studying all stages of the procedure in advance. Knowledge of the requirements allows the sale to be conducted quickly and without unnecessary bureaucratic obstacles. The owner receives the conclusion, the parties sign a contract corresponding to the market price, and the car passes to the new owner.

### Changes in the pension levy

In addition to valuation issues, the car market is also affected by changes in the fiscal burden. From January 1, 2026, new rules for calculating the pension levy upon the first registration of passenger cars will come into force. The levy rate is now differentiated and depends on the cost of the car: it may be 3%, 4%, or 5%. At the same time, electric vehicles retain their privileged status and remain exempt from paying this levy.
