## 🎯 Key Points

- Unofficial work deprives the employee of a pension, sick leave, and vacation.
- Employers risk fines up to 259,410 hryvnias for each employee without a contract.
- The court can oblige the employer to pay salary at the regional average and pay additional taxes.
- In 2026, 78% of companies are experiencing a labor shortage, which increases risks during inspections.

Amid economic instability and a labor shortage observed in Ukraine in 2026, the practice of unofficial employment remains widespread. Many job seekers and employers view working "in the shadows" as a way to save on taxes or receive a higher "net" salary. However, as experts note, such a scheme carries critical risks for both parties, which in the long term may outweigh short-term benefits.

### Loss of social guarantees and pension savings

According to comments by lawyer and Master of Law Yevhen Bulymenko, the absence of an official labor contract deprives the employee of protection provided by legislation. In the event of a conflict, the employer has the opportunity to terminate cooperation unilaterally without paying compensation. Furthermore, the employee loses the right to paid vacation and sick leave payments.

Particular concern is raised by the impact of "gray" work on citizens' futures. Periods of work without official registration are not counted towards insurance seniority. This means that a person may face a significantly reduced pension amount in the future or even be completely deprived of the right to receive it. Guarantees related to pregnancy, childbirth, and education also disappear, making the employee's position extremely vulnerable.

### Legal mechanisms for protecting workers' rights

Despite the risks, the absence of a paper contract does not mean the employee is left defenseless. According to paragraph 6 of Article 232 of the Labor Code of Ukraine, an employee has the right to file a lawsuit in court to establish de facto labor relations. If the court sides with the employee, the employer will be obliged to formalize the relationship retroactively.

It is important to note that in the event of a court victory, the salary will be recovered at a rate not lower than the regional average, regardless of actual payments that may have been lower. Moreover, the employer will be obliged to pay personal income tax (PIT) and the single social contribution (SSC) for the entire established period of work, which may become a heavy financial burden for them.

### Financial liability of employers in 2026

Legislation is tightening liability for companies that allow employees to work without registration. Fines for such violations reach significant amounts. For the actual admission of an employee without a contract, a fine is imposed in the amount of ten times the minimum wage. As of the current moment, this amounts to 86,470 hryvnias for each illegally employed employee.

If the violation is detected again within two years, the fine amount increases to 30 minimum wages, which is equivalent to 259,410 hryvnias per employee. These measures are designed to stimulate businesses to legalize labor relations, especially against the backdrop of an acute labor shortage, when 78% of companies are experiencing a lack of personnel.
