# Zakarpattia scandal: Man with disability and tuberculosis illegally detained at TCC

A high-profile incident involving human rights violations during mobilization activities has erupted in the Zakarpattia region. A local resident born in 1970, who has a disability and suffers from tuberculosis, was taken to a territorial center and was unable to leave the building, despite having documents confirming his right to deferment.

The situation was commented on by the Ombudsman of the Verkhovna Rada of Ukraine, Dmytro Lubyntsev. According to him, a complaint was filed with the ombudsman regarding the illegal actions of law enforcement officers and the military commissariat.

### Violation of rights and denial of medical assistance

According to the details of the complaint, the man was taken to one of the subdivisions of the Zakarpattia Regional TCC and SP. The center's employees ignored the provided documents granting the right to deferment from conscription. Furthermore, the complaint emphasizes that the applicant's health condition requires constant treatment and regular intake of specific medications.

During his detention in the military commissariat building, the man was not provided with necessary medical assistance, and access to medication was restricted. This created a direct threat to his health, especially since he was not subject to conscription anyway.

### Ombudsman's reaction and investigation results

After receiving the complaint, Dmytro Lubyntsev immediately instructed his representative in the Zakarpattia region, Andriy Kryuchkov, to investigate the circumstances of the case. As a result of the human rights defender's intervention, the man was released, and his legal right to deferment was restored.

The Ombudsman emphasized that mobilization during wartime is a necessity, but it must be conducted strictly within the framework of the law. In his opinion, ignoring citizens' rights confirmed by documents is unacceptable.

"A person with a disability and a legal right to deferment should not be illegally detained or deprived of their rights. Turning a blind eye to obvious facts is unacceptable," Lubyntsev stated.

### Launch of investigative procedures

The incident has escalated into a full-scale investigation at the state level. A report regarding possible abuse of power by a military official has been sent to the Specialized Prosecutor's Office in the field of defense of the Western region. A signal regarding possible abuse of power by a police officer has been submitted to the State Bureau of Investigation (SBI).

Furthermore, Dmytro Lubyntsev has appealed to the Military Law Enforcement Service of the Armed Forces of Ukraine and the Operational Command "West" with a request to conduct an internal investigation.

### Consequences for trust in the system

The Ombudsman warned that such cases do not contribute to strengthening the country's defense capabilities. On the contrary, they discredit the very idea of mobilization and undermine citizens' trust in state institutions.

This is not the first time Lubyntsev has intervened in questions of the legality of mobilization. Previously, he reported on a situation in the Dnipropetrovsk region where a single father raising a five-year-old daughter was conscripted. At that time, the TCC claimed that the man had not provided documentary confirmation of his right to deferment, although the investigation into the legality of the actions is ongoing.
