Residing abroad does not exempt a parent from their legal obligation to support their child. The Consular Service Department of the Ministry of Foreign Affairs of Ukraine reminds citizens of the mechanisms for the enforcement of child support payments when the debtor is in another jurisdiction and avoids voluntary payments. Availability of an Existing Court Decision

If the plaintiff already holds an official Ukrainian court decision on alimony recovery, the procedure is significantly simplified, although it still requires going through certain bureaucratic steps. In this case, it is necessary to contact the court of first instance that issued the initial decision to obtain the documents required for the recognition and enforcement of the judicial verdict abroad. After receiving certified copies and translations, the documents are submitted to the competent authority of the foreign state where the payer resides or receives income.

In situations where a court decision does not yet exist, the course of action is determined by the current place of residence of the child and both parents. Legislation allows filing a lawsuit in a Ukrainian court — specifically at the registered place of residence or stay of the plaintiff. However, in certain cases, jurisdiction requires applying directly to the courts of the debtor's country of residence. International legal assistance treaties play a key role here, regulating the cross-border movement of documents and the procedure for resolving family disputes.

Importantly, factors such as official unemployment or low declared income of the payer abroad do not exempt them from payments if the court establishes a discrepancy between their real standard of living and expenses versus declared income.
