The European Union has made a historic decision to extend the temporary protection mechanism for Ukrainian citizens. The status, which ensures safety and legal residence in EU countries, will remain in effect until March 4, 2028. However, the conditions for obtaining asylum have undergone significant changes: access to the program will now be strictly regulated and linked to citizens fulfilling their obligations to the state.
New rules: priority for those defending the country
As reported by RBK-Ukraine citing a statement from the European Council, EU member states have agreed to introduce strict criteria. In the future, temporary protection will be granted exclusively to Ukrainian citizens who confirm they are fulfilling their military obligations. This decision is dictated by the need to balance humanitarian aid with support for Kyiv's defense capabilities.
Ireland's Minister for Justice, Equality and Migration, Jim O'Callaghan, emphasized that the EU's position remains unchanged in its support for the Ukrainian people. At the same time, European partners are striving to ensure that Ukraine retains the ability to effectively defend itself against Russian aggression. The updated scheme is designed to account for the state's legitimate defense needs.
How to confirm the right to protection
For new applicants, the procedure for obtaining status will become more complex. To claim temporary protection, one must provide documentary proof of fulfilling military obligations. The decision clearly outlines the rules for this restriction, providing several methods for verifying a citizen's status.
The special temporary protection mechanism was first activated in March 2022, immediately following the start of the full-scale Russian invasion. Over the past years, 4.38 million people have utilized the assistance and safe asylum program. Now, by extending the status for another year, the European Union is introducing a filter aimed at preserving Ukraine's human capital during the war.
