Pedestrians in Ukraine are full-fledged participants in road traffic, which imposes on them the obligation to strictly comply with the Rules of the Road (ROR). Ignoring these norms entails real liability under the legislation: from monetary fines to mandatory community service.
A detailed analysis of penalties and administrative liability procedures was presented by lawyer and Master of Law Yevhen Bulymenko in a comment to RBC-Ukraine.
Legal Status and Article 127 of the Code of Ukraine on Administrative Offenses
The lawyer emphasized that pedestrians bear responsibility for violating traffic rules on par with drivers of motor vehicles. The basis for liability is Article 127 of the Code of Ukraine on Administrative Offenses (CUAO).
According to the expert's clarifications, the standard fine for pedestrian violations is 340 hryvnias. However, the amount of the fine may be increased depending on the circumstances.
Increased Liability for Violations While Intoxicated
The lawyer paid special attention to violations committed by persons in a state of intoxication. In this case, the fine is doubled and amounts to 680 hryvnias.
If the violation led to the creation of an emergency situation on the road, the punishment may be aggravated. In such situations, a pedestrian may be fined an amount from 680 to 850 hryvnias or sentenced to mandatory community service for a term of 40 to 60 hours.
Court Procedure and Appeal
The decision to impose an administrative penalty in the event of creating an emergency situation is made by the court. This distinguishes such cases from standard protocols, which are drawn up by law enforcement officers.
The lawyer also clarified the procedure for appealing the ruling. If a pedestrian disagrees with the decision, they have the right to file a complaint no later than 5 days from the date of notification of the refusal to satisfy the first complaint.
Consequences of Non-Payment of Fines
In the event that the issued fine is not paid within the time limit established by law, additional liability ensues. The law provides mechanisms for the compulsory recovery of debts to the state.
The expert reminded that road safety depends on the discipline of all road users. Knowing one's rights and obligations, as well as understanding the consequences of violations, helps avoid not only fines but also dangerous situations on the roadway.
