Lawyer Alena Chmona explained that a pensioner is not obliged to return an “excess” pension to the PFU if the overpayment arose due to an error of the Fund itself. Under Article 50 of the pension law, recovery is possible only in cases of abuse of rights or the provision of inaccurate data by the citizen.
