The Cabinet of Ministers of Ukraine has amended the procedure for reserving liable-for-military-service employees during mobilization and martial law. This is stipulated in Resolution No. 1328 dated October 23, 2026, which introduces changes to current legislation, establishes a new consultative body under the government, and revises the criteria and verification procedure for the status of critical enterprises. The document details how to coordinate quota increases above the base rate, what restrictions apply to the defense-industrial and fuel-and-energy complexes, and how to process reservations via the Diia service.
What changed in the resolution
The government instructed central executive authorities, other state bodies, as well as regional, Kyiv, and Sevastopol city state administrations (military administrations) to ensure its implementation within ten days from the date the resolution enters into force. All decisions on designating enterprises as critical that are valid on the date the document enters into force shall remain in effect for the period for which they were adopted, except for those cancelled as a result of a criteria review.
Coordination Center: A new consultative body
The resolution establishes a Coordination Center for the organization of conscript reservations during mobilization and wartime, and approves its composition and regulations. The Center is co-chaired by the Deputy Ministers of Economy and Defense, and its composition includes representatives of key ministries, agencies, and security structures. The body is consultative in nature: it prepares recommendations and proposals, while the final decision is made by the authorized state body. The Center also has the right to refuse to consider proposals to increase reservation volumes if violations by the enterprise management are detected.
Quotas: 50% as a baseline and exceptions
The baseline reservation quota is 50% of liable-for-military-service employees. The declared number of those subject to reservation may exceed 50% by decision of the state body that recognized the enterprise, institution, or organization as critical. The respective state body submits justified proposals for increasing the quota to the Coordination Center, and the final decision is made taking into account the received recommendations. The resolution also defined the grounds on which an enterprise may be refused consideration of such proposals.
Defense and Energy Complexes: 95% cap
A maximum reservation level has been established for enterprises of the defense-industrial and fuel-and-energy complexes: the number of conscript employees subject to reservation must not exceed 95% of their total number specified in the decision of the Ministry of Defense or the Ministry of Energy. According to the document, the reduction of the maximum volume to 95% was adopted taking into account the fact that all conscript employees directly involved in the production processes of critical institutions are subject to mandatory reservation.
Donor organizations and international technical assistance: A 7-person ceiling
Separate requirements have been introduced for representative offices of donor institutions and executors of international technical assistance projects. The number of conscripts subject to reservation in such organizations must not exceed 50% of the number of employees directly involved in performing the tasks of a single project, and no more than 7 people. The 7-person limit can be exceeded by a decision of the State Secretary of the Cabinet of Ministers.
Deadlines and processing via Diia
The resolution details the reservation procedure, defining clear requirements for increasing quota limits, deadlines for processing via the Diia service, and updating the criteria for designating enterprises as critical. Ministry of Defense decisions on increasing reservation volumes adopted before December 8, 2025, remain valid for the entire validity period of the enterprise's criticality status, but no longer than December 8, 2026; decisions adopted after this date remain valid for the duration of the criticality status, but no longer than the period specified in the decision itself.
