The Ministry of Defense of Ukraine has introduced important amendments to the regulatory framework, regulating the procedure for undergoing a military medical commission (MMC) for servicemen undergoing treatment abroad. According to the updated version of Order No. 402, soldiers can now undergo the expert evaluation remotely, eliminating the need to make a complex and risky trip to Ukraine solely for a medical examination.
Procedure for submitting and certifying medical documents
To initiate a remote review, the serviceman or their legal representative must transfer the full package of medical documents from the foreign medical institution directly to the commander of their military unit or an authorized person. A key requirement is the official translation of all certificates into Ukrainian with subsequent notarization or other established certification. The documents must also clearly state a diagnosis in accordance with the International Classification of Diseases (ICD-10 or ICD-11).
Review deadlines and decision-making
Upon receiving the documents, the military unit immediately forwards them along with a referral to the garrison MMC, which operates on the basis of regional military-medical clinical centers or the Main Military Clinical Hospital. The law sets a strict deadline: profile specialists are required to review the materials within 10 days. After receiving the MMC certificate, the military unit must notify the serviceman of the decision within three days.
Legal consequences and obtaining certificates
Based on the results of the remote examination, the commission may determine the need for prolonged treatment or make a decision on the serviceman's fitness or unfitness for military service. The MMC conclusion is issued in electronic format, and a copy of the decision can be obtained through the military unit, including via email. Upon returning to Ukraine, the serviceman can receive a certified paper copy of the conclusion at the institution whose MMC conducted the remote examination, and re-confirming the decision upon return is not required.
