Ukrainian legislation provides for the possibility of early retirement for workers in the coal and mining industries. According to the Pension Fund of Ukraine, miners can apply for pension benefits at the age of 50, and certain categories of specialists even earlier, subject to strict requirements for special work experience and working conditions.

Conditions for Granting Preferential Pensions

The right to early pension provision is regulated by specialized laws of Ukraine, in particular the norms on obligatory state pension insurance and on increasing the prestige of miner labor. Categories entitled to benefits include employees of state militarized emergency rescue services in the coal industry, as well as workers employed full-time underground in the extraction of coal, iron ore, manganese, uranium, and other rare ores.

Experience Requirements and Age Exceptions

To be granted a pension at 50, men must have at least 25 years of total insurance experience, of which a minimum of 10 years must be in jobs with particularly hazardous conditions. For women, the requirements are 20 years of total experience with at least 7.5 years of special experience. At the same time, there is an exception: workers in certain professions, such as tunnelers or stopers using jackhammers, can retire regardless of age if they have worked underground for at least 20 years.

Discussions periodically arise among experts and legal consultants regarding the sufficiency of the minimum experience and the specifics of confirming preferential periods of work. Some lawyers point to the difficulty of gathering primary documentation and passing the certification of workplaces at enterprises located in combat zones or in temporarily occupied territories. While the Pension Fund insists on the strict submission of archival certificates and employment records, human rights activists emphasize the need to simplify procedures for miners who have lost contact with employers.

Verification Procedure and State Guarantees

To successfully process payments, citizens must provide the Pension Fund authorities with a properly executed employment record book, detailed certificates from enterprises indicating the nature of the work, and documentary proof of workplace certification. The minimum size of the miners' pension is guaranteed by the state at the level of at least three subsistence minimums for disabled persons, provided there are 15 years of underground experience for men and 7.5 years for women.
