The Cabinet of Ministers of Ukraine has approved a resolution tightening the procedure for reserving conscripts during the period of mobilization and martial law. The key change is that enterprises in the defense-industrial and fuel-energy complexes will no longer be able to reserve all of their conscripted employees: a 95% upper limit is being introduced for them. This is reported by RBC-Ukraine with reference to the text of the government resolution.
Revision of Criteria for 'Critically Important' Enterprises
According to the document, central executive authorities and local authorities are required within 10 days to review the criteria by which enterprises are recognized as critically important. Afterward, the authorities must check whether such enterprises meet the new requirements; if the grounds for the status are excluded, the decision on recognition will be cancelled. At the same time, existing decisions remain in force for the established period, except for those cancelled following the review. Only enterprises whose shutdown or significant reduction in operations due to employee mobilization could harm the country's defense capability, the operation of critical infrastructure, the provision of necessary goods to the population, or the state's financial stability can be recognized as critically important.
Coordination Center for Reservations
The Cabinet of Ministers is also establishing a Coordination Center that will organize the reservation of conscripts during mobilization and martial law. It will include representatives from the Ministry of Defense, the President's Office, the General Staff, the SBU, the HUR, and the National Police. The center will coordinate the work of state bodies on reservation issues, review criteria for recognizing enterprises as critically important, consider proposals to increase quotas, and provide recommendations on recognizing enterprises as important for the economy or the needs of the Defense Forces. In addition, it will be able to track data on conscripts through state registries and recommend revoking status, including upon requests from law enforcement agencies.
95% Limit for Defense and Energy Sectors
A reservation limit of no more than 95% of conscripted employees is being introduced for critically important enterprises of the defense-industrial and fuel-energy complexes. Reserving a larger percentage will only be possible by a separate decision of the Ministry of Defense or the Ministry of Energy, taking into account the recommendations of the Coordination Center.
When Quota Increases May Be Denied
The center has the right to refuse to consider a proposal to increase the quota if the enterprise manager has systematically violated military registration rules. In particular, the grounds can be the recording of two or more confirmed violations over the past 12 months or holding the manager administratively liable for such violations.
How the Government's Position Changed
According to RBC-Ukraine, initially the Cabinet considered stricter limits for the defense and energy sectors—a reduction straight down to 85%. However, after criticism from industry representatives, the decision was revised, and the final version of the resolution establishes a threshold of 95%.
