The Cabinet of Ministers of Ukraine has officially approved an important draft law that fundamentally determines new behavioral rules and action algorithms for military personnel in the event of a potential conflict of interest. The initiative was developed by the Ministry of Defense of Ukraine, and the innovations are designed to improve the Internal Service Charter of the Armed Forces of Ukraine.

The Essence of Changes and Commander Action Algorithms

The main purpose of the adopted bill is to clearly regulate situations where the execution of a service order may intersect with personal or official contradictions. According to the new norms, if a serviceman officially reports a real or potential conflict of interest, the commander acquires an unconditional obligation to take comprehensive measures to resolve the situation.

In cases where a subordinate reports a conflict caused by an order from higher command, the immediate commander is obliged to promptly inform the senior commander. At the same time, strict timeframes are established: the serviceman must notify the management no later than the next working day from the moment he became aware of the conflict of interest.

Special Procedures and Anti-Corruption Restrictions

Special attention in the document is paid to military personnel whose positions imply a direct supervisor of a special status, or cases where the collision affects collegial bodies. In such situations, the notification must be sent directly to the National Agency on Corruption Prevention (NACP) or another state body defined by law.

The draft law also fixes the personal responsibility of commanders for monitoring compliance with anti-corruption standards by subordinates. The document clearly regulates the list of persons subject to restrictions on the use of official position, receiving gifts, combination of jobs, and work of close relatives. Similar strict requirements are introduced for the management and members of military medical commissions (MMC) and medical and social expert commissions (MSEC).

Contradictory Data

Despite the general transparency of the Ministry of Defense initiative, discussions are emerging in the information space regarding the practical implementation of the new norms in combat conditions. Some experts express concerns that rigid bureaucratic procedures for notifying management or the NACP may slow down the process of making operational decisions at the front line. At the same time, the developers of the bill insist that a clear legal mechanism will protect both rank-and-file servicemen and the command from corruption risks and abuses.
