The Pension Fund of Ukraine (PFU) has clarified how two types of state support for housing and communal services (HCS) interact — the housing subsidy and the preferential discount. The key point emphasized by the Fund: a person who is entitled to both a housing subsidy and a benefit is not required to receive both forms of assistance — they have the right to choose one. This means that the subsidy and the benefit are not cumulative; they are applied alternatively, at the citizen's choice.
When the subsidy equals zero: the right to the benefit is preserved
The PFU paid particular attention to the situation in which the calculated amount of the housing subsidy comes to 0.00 UAH. In such a case, a person entitled to a benefit may file an application for it, and the benefit will be granted from the month of the application. Thus, a zero result in the subsidy calculation does not deprive a person of the right to an alternative form of support — on the contrary, it is the basis for switching to the benefit.
Condition: an entry in the Register of Persons Entitled to Benefits
The Pension Fund also reminded of a formal requirement: to receive a benefit, a person must be entered in the Register of Persons Entitled to Benefits. Without the corresponding entry in the register, the discount cannot be processed, so citizens claiming support should verify that their data in the register is up to date before filing an application.
Who is entitled to the 50% discount
Under Article 15 of the Law of Ukraine "On the Status of Veterans of War and Guarantees of Their Social Protection," the families of deceased Defenders of Ukraine are entitled to a 50% discount on the payment of the corresponding communal services. The full list of services to which the discount applies is set out in the text of the law; the PFU's clarification focuses on the right to choose between the subsidy and the benefit and on the procedure for its assignment.
Norms for families consisting of non-working persons
For families consisting solely of non-working persons (for example, only pensioners), a 50% discount on gas for heating the dwelling is provided within the limit of twice the standard heating area. The specific norms are 42 sq. m per person entitled to the benefit and 21 sq. m per family. These parameters determine the area over which the discount actually applies.
Switching to the subsidy during the heating season and automatic resumption of the benefit
If, with the start of the heating season, a benefit recipient wishes to use the housing subsidy instead of the discount, they must contact the Pension Fund and file the corresponding application. The PFU clarified that in the next non-heating season the benefit will be resumed automatically if the assigned housing subsidy amounts to 0.00 UAH. This creates a closed mechanism in which a zero subsidy once again opens up the right to the benefit without reprocessing.
