Ukraine has introduced a new temporary reservation mechanism designed to address the acute problem of military registration at critical enterprises. Employers can now protect their employees from mobilization for up to 45 days, even if the specialists have documentation violations or are listed as wanted.
The essence of the new service on the 'Diia' portal
Elizaveta Korobeinikova, a lawyer from the 'Actum' association, explained the details of the new function to RBC-Ukraine. It has been developed as a transitional tool, allowing critical infrastructure enterprises (KVE) to quickly reserve personnel who have encountered difficulties with military registration.
It is important to understand that this type of reservation is not permanent. It is granted solely to provide time to put documents in order. The validity period of the temporary reservation is limited to 45 calendar days.
Automation and speed
The procedure is maximally simplified thanks to digitization. As soon as the employer compiles a list of employees in the 'Diia' app, the transfer of the conscript to special military registration occurs automatically. The system processes the application within 24 hours.
Most often, temporary deferment is arranged in the following cases:
- Absence of a military registration document;
- Failure to register for military service;
- Unclear or outdated data in the registry;
- Having a 'wanted' status via the Territorial Recruitment and Social Support Centers (TRC and SP).
Action algorithm for employers
Obtaining a temporary reservation is only the first step. To keep an employee on staff and avoid legal problems, it is necessary to strictly follow the algorithm for correcting errors within the allotted 45 days.
Lawyers warn: do not postpone the visit to the military commissariat or document correction until the last days of the term. Technical delays may occur in the registries, which will not allow for the timely arrangement of a full reservation. As soon as the violations are eliminated, the temporary reservation must be annulled and a full reservation must be arranged immediately on general grounds.
