The Permanent Court of Arbitration in The Hague has issued a landmark final decision in the lawsuit filed by Ukraine's PrivatBank against the Russian Federation. The international arbitration tribunal ordered the Russian side to pay over $327 million in compensation for the illegal expropriation and seizure of the financial institution's assets on the temporarily occupied Crimean Peninsula. This verdict marks the culmination of a protracted legal confrontation that began with the region's annexation in 2014.
Background and Essence of the Legal Conflict
Until the spring of 2014, PrivatBank owned an extensive network of branches, large commercial real estate, a liquid loan portfolio, and substantial cash reserves in the Autonomous Republic of Crimea. Following the establishment of control over the peninsula, the Russian authorities effectively expropriated this property, depriving the Ukrainian bank of the ability to manage its investments. In response, the bank's management initiated a large-scale arbitration process against Russia in 2015, relying on the provisions of the bilateral investment protection agreement signed back in 1998.
Stages of the Legal Marathon and The Hague's Position
The legal battle was accompanied by serious resistance from the respondent. In the early stages, the international arbitration recognized the seizure of Crimean assets as unlawful. Seeking to challenge this, Russia appealed to the Hague Court of Appeal in 2019, which completely dismissed the Russian side's complaints in 2022. A subsequent appeal to the Supreme Court of the Netherlands in 2024 further upheld the legitimacy of the interim rulings, eliminating opportunities for further procedural maneuvers by Moscow and allowing the arbitration to calculate precise financial losses.
Compensation Structure and Next Steps
The final amount exceeding $327 million is formed not only from the direct value of the lost property but also includes accumulated interest accrued starting from April 18, 2014, which will continue to accrue until full repayment of the debt. Additionally, the court ordered the reimbursement of all associated legal costs incurred by the bank. Representatives of the Ukrainian financial institution emphasize their readiness to utilize all available international legal enforcement mechanisms to protect the interests of their stakeholders.
